Disputes

In the event of any dispute arising from, or in connection with, these Terms (Dispute), the party claiming there is a Dispute must give written notice to the other party setting out the details of the Dispute and proposing a resolution. Within 7 days after receiving the notice, the parties must, by their senior executives or senior managers (who have the authority to reach a resolution on behalf of the party), meet at least once to attempt to resolve the Dispute or agree on the method of resolving the Dispute by other means, in good faith. All aspects of every such conference, except the fact of the occurrence of the conference, will be privileged. If the parties do not resolve the Dispute, or (if the Dispute is not resolved) agree on an alternate method to resolve the Dispute, within 21 days after receipt of the notice, the Dispute may be referred by either party (by notice in writing to the other party) to litigation.

Severance

If a provision of these Terms is held to be void, invalid, illegal or unenforceable, that provision must be read down as narrowly as necessary to allow it to be valid or enforceable. If it is not possible to read down a provision (in whole or in part), that provision (or that part of that provision) is severed from these Terms without affecting the validity or enforceability of the remainder of that provision or the other provisions in these Terms.

Jurisdiction

Your use of our Site and these Terms are governed by the laws of Victoria, Australia. You irrevocably and unconditionally submit to the exclusive jurisdiction of the courts operating in Victoria, Australia and any courts entitled to hear appeals from those courts and waive any right to object to proceedings being brought in those courts. 

Our Site may be accessed throughout Australia and overseas. We make no representation that our Site complies with the laws (including intellectual property laws) of any country outside Australia. If you access our Site from outside Australia, you do so at your own risk and are responsible for complying with the laws of the jurisdiction where you access our Site.

Warranty

 

2 Year Limited Warranty

All AS I AM® timepieces are warranted to be free from defects in materials and workmanship for a period of 2 years from the original date of purchase (‘Warranty Period’) in accordance with the terms and conditions of this Limited Warranty. This Limited Warranty:

  1. covers the timepiece case and movement only;
  2. applies only to timepieces purchased from us or our authorised resellers; and
  3. is for the benefit of end consumers and does not apply to products purchased for resale.

You must retain the original warranty card in order to make a claim under this Limited Warranty.

What this Limited Warranty does not cover

This Limited Warranty does not cover:

  1. the timepiece battery, crystal / glass, strap or bracelet;
  2. defects or damage caused by normal wear and tear; accident, neglect, negligence or misuse; incorrect use, operation or maintenance (including failure to follow product documentation); disassembly, alterations, incorrect handling or unauthorised repairs; or
  3. water damage or damage caused by extreme heat, cold or environmental conditions.

What we will do under this Limited Warranty

If we assess that a timepiece returned during the Warranty Period has a defect covered by this Limited Warranty, we will at our cost and option:

  1. repair the defective product; or
  2. replace the defective product.

In the case of replacement, we cannot guarantee that you will receive the same model timepiece. If your timepiece model is not available, a timepiece of equal value and similar style will be provided. Repairs will be covered under this Limited Warranty for the remainder of the original Warranty Period. Replacements will be covered under this Limited Warranty for a period of 2 years from the date the replacement is sent. Returned products and any parts that have been replaced will become our exclusive property. If we determine that a returned timepiece is not defective or not covered by this Limited Warranty, we may require you to: (a) reimburse our reasonable costs of inspecting and testing the product; and (b) pay the costs of returning the product to you.

How to make claim under this Limited Warranty

To make a claim under this Limited Warranty, you must:

  1. send an email to info@asiam.com.au during the Warranty Period and provide your name, contact information, proof of purchase (this can be your order confirmation email), description of the defect and any other information we require; and
  2. return the timepiece to us, along with the original warranty card, by sending it to our nominated address.

Unless we agree otherwise, you are responsible for all costs associated with returning a product to us. We recommend that you use a reputable carrier, insure your shipment and use secure packaging. Products will be at your risk while they are in transit to and from our nominated address. We will be responsible for the costs associated with sending you the repaired or replacement timepiece. We may reject claims under this Limited Warranty that are not made in accordance with these terms.

Additional terms

If any provision of this Limited Warranty is invalid or unenforceable, it must be read down to the point of severance (if necessary) and does not affect the remaining provisions. To the maximum extent permitted by law, we will not be liable for any failure or delay in meeting our obligations under this Limited Warranty to the extent that this is due to circumstances beyond our reasonable control. The benefits given to you by this Limited Warranty are in addition to other rights and remedies you have under law in relation to products to which this Limited Warranty relates.

The following applies to AS I AM® timepieces purchased in Australia. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

AS I AM® Pty Ltd ABN 44164119878 (we, us or our) operates and maintains this website. These terms and conditions (Terms) apply to your use of and purchases from this website. You should read these Terms carefully. By using this website and placing an order, you agree to these Terms.

We may change these terms at any time by publishing the changed terms on this website, but such changes will not operate retrospectively.

Orders

Each order you submit is an offer to purchase goods from us. You should take care when submitting an order as submitted orders cannot be changed or cancelled.

Orders are not binding on us until we accept them. We may accept an order by written notice or by supplying the goods ordered. We may reject an order at our sole discretion.

Each order we accept creates a separate contract for the supply of the goods ordered in accordance with these Terms. We may cancel an accepted order and refund any amount paid: (a) if the ordered goods are out of stock or unavailable; (b) because of an error on our website (e.g. in a product description, image or price); or (c) if we are unable to supply the goods due to circumstances beyond our reasonable control; or (d) for any other reason.

Price and payment

Prices are in Australian Dollars and inclusive of GST (if applicable).

We will use reasonable efforts to ensure prices displayed on our website are correct.

We may change prices at any time. Price changes will not affect orders that have already been submitted or accepted, except where there is an obvious error.

You must pay the price, any delivery fee and any applicable taxes, when an order is submitted. We will provide a refund if the order is rejected or cancelled for any reason.

Payment may be made by credit card, PayPal or other approved payment method. AfterPay is available to customers in Australia and the United States for orders with a maximum value of AUD1,000. If you pay using AfterPay, the AfterPay prevailing terms and conditions will apply (see: www.afterpay.com).

Delivery

Any delivery times that we quote are estimates only.

Risk and title in goods passes to you when they are delivered to your nominated delivery address.

Where a delivery address is outside of Australia, your order may be subject to import duties and taxes. You are solely responsible for payment of such import duties and taxes. If you are unsure whether import duties and taxes apply, you should contact your local customs office.

Returns and exchanges

All purchases are final

We do not offer refunds or exchanges for change of mind returns.

Each AS I AM timepiece has been crafted with quality parts that are made to last, with you. The materials that strengthen it are:

Care

It’s important to protect your timepiece so that it stands the test of time. Our timepieces can resist splashes of water from hand washing, but won’t be able to withstand water submersion. So please don’t wear them when swimming or bathing. If your timepiece has a leather band/strap, we suggest you avoid excessive exposure to water.

Stock Availability

AS I AM timepieces are only available for purchase via this online store. If a particular timepiece is noted as sold out, please try ordering again at a later date.

Payment

All prices are in AUD. We accept Visa, Mastercard, and American Express credit/debit cards on our website through our secure checkout.
For our Australian based customers, we have also partnered with AfterPay to allow for flexible payment options. AfterPay allows you to pay for your order (up to $1000AUD to approved customers) in four instalments over equal fortnightly payments.
These payments are interest free and carry no additional fees if you pay on time. For more information on how AfterPay works and Terms and Conditions, please visit the AfterPay website.

Shipping

AS I AM delivers to a selection of countries worldwide. All orders within Australia and New Zealand generally take 7 to 10 business days from the date of purchase. For international orders please allow 7 to 21 business days. Please note that these timeframes can vary depending on your location, customs and your local postal service.
Shipping charges are clearly stated at the bottom of the order screen before proceeding with payment.

Changes & Cancellations

Unfortunately, changes and cancellations cannot be made once an order has been processed. However, please contact us immediately at info@asiam.com.au and we will see how we can help.
If you realise that the shipping address or email was entered incorrectly after making an order, please let us know at info@asiam.com.au

 

Warranty

Each AS I AM timepiece is thoughtfully minimal in design, and crafted with quality materials and components to offer precise, reliable performance. We proudly stand behind every AS I AM timepiece we sell.

2 Year Limited Warranty:

AS I AM warrants to the original consumer that his/her timepiece will be free from defects in materials and workmanship that prevent the timepiece from functioning properly under normal use, for a period of two (2) years after original purchase.
In the event you would like to return a timepiece to us under warranty, please send us an email at info@asiam.com.au.

Warranty Exclusions:

This limited warranty does not apply to AS I AM timepieces purchased from anywhere else other than the official AS I AM website.
This limited warranty does not cover batteries, straps, bracelets, crystals, glass, gold or ionic-plating, PVD finishing cosmetic issues such as scratches or normal wear and tear, or any damage arising from accidents or misuse including water penetration or from any alteration.
